Harvey Weinstein was sentenced to 23 years behind bars earlier today. But the fallen movie mogul only spent a short amount of time in jail before being taken to the hospital, Variety has learned.
Weinstein is currently at New York City’s Bellevue Hospital, and will likely stay overnight, according to his spokesperson.
Weinstein was taken to Rikers Island from the Manhattan courthouse where he was sentenced. He then began having chest pains, so the staff at Rikers decided to send him back to Bellevue “for safety,” his spokesperson said.
“We appreciate the care and concern of the Department of Corrections officers and staff,” the spokesperson said.
On Tuesday, Weinstein was sentenced to 23 years in New York State prison on charges of sexual assault and third-degree rape, and will be formally registered as a sex offender.
While the prosecution urged the judge to give Weinstein the maximum sentence of 29 years, Weinstein’s defense pleaded for the judge to give him a minimum sentence of five years, largely due to his age and poor health.
“Mr. Weinstein is a sick man,” his lead attorney, Donna Rotunno told the judge. “Mr. Weinstein has a multitude of issues.”
In her plea to give Weinstein a short prison term, Rotunno said she has reason to believe he may not even survive the shortest sentence of five years, stating, “That is a very sad circumstance, but it’s a potential fact.”
Leading up to his sentencing, Weinstein spent much of the past few weeks in the hospital.
After he was convicted on Feb. 24 and remanded into custody, he was diverted to Bellevue directly from the courthouse. At the time, Weinstein had also complained of chest pains.
He stayed at Bellevue for 10 days and then had a heart procedure to remove a blockage, before the medical staff deemed he was in sufficient health to be transferred to Rikers. He was held in the North Infirmary Command, the jail’s medical facility, for five days, before his sentencing on Wednesday morning.
In court, Justice James Burke said, “In regard to your medical situation, New York judges have no power… but obviously medical attention is required.”
Weinstein’s team hopes he will ultimately be sent to Fishkill Correctional Facility, a state prison that has a medical unit.
